I need to know the basics for sampling. Is there a certain procedure to it? Do I have to ask for permission to use the track? You know those types of things...:confused:

If you are asking for legal stuff: Depends on what kind of sample you want to use. If you want to sample an existing song you have to ask for a permission (if you would like to sample bigger bands like daft punk, that will be nearly impossible to get theese). If you want to use a sample offered by a website or smth. (like loopmasters maybe) it depends on the website's legal conditions. Refering to loopmasters you can use the sample in a comercial way after buying it. But that depends on the website...

Sampling and making music don't have to be hard. Just get the Vengeance French House Sample pack.

Not legally, though it's true that (in most cases) you wouldn't be legally pursued over it. Still though, it's not actually legal to sample a song without permission, whether you're making money on it or not.

(Of course, the laws may be different in Australia, but I know that these are the laws for at least the US and the UK)

i believe you're allowed to sample as long as you don't do it for any monetary gain. and usually if the song gets popular then you can probably get the rights to the sample plus be allowed to obtain samples a lot easier due to reputation

I think the legal peoples at record labels have bigger legal fish to fry than small artists sampling their tracks if they aren't getting any money for it.

It's still illegal, whether you make money from it or not. Yes, it's true that in the past people have sampled illegally, had their track be popular, and THEN cleared the sample. It's also true that in cases like those the record label who owns the original work (the work that you sampled) holds all the legal cards - they could, in theory, win the rights to the sales of your song.

Still though, like something awesome said, the legal people at record labels DO usually have bigger legal fish to fry. But we weren't really discussing whether you would get caught, we were discussing whether sampling without permission was legal - and it's not.

Remember - technically all the DJ sets that people post on their Soundclouds and what not are illegal (unless of course they get permission, which is unlikely). All the unofficial remixes are illegal. Even more technically, unless you have the proper license and paperwork playing copyrighted songs in your live DJ set is illegal. Do the people who do these things ever get pursued legally? Barely ever, unless, of course, big money is involved.

Sampling can really annoy me.
Granted it can be fine in small bits that can be hard to distinguish but longish iconic sounds really make my moustache twitch.
