    I googled that and it seems that based on the ruling in that case you can sample two seconds from a song if you don't sample the melody and if the resulting song is very different from the sampled song. At least in Germany.

    If you want to be legal out of respect for the law and the intentions behind the law then don't do anything creative. In fact, don't breathe, because breathing produces CO2, a greenhouse gas and you don't have a permit for that.

    If you're worried about being sued then either 1. Stay non-commercial like me and sample whatever you want, however you want, 2. Make sure nobody can tell or 3. Be rich, because rich people get to do whatever they want.

    i don't think your case would be somethin' to sweat hard over, particularly because you haven't used it for financial gain. i'm not some fancy, big city lawyer, so don't take my opinions as your own; but as long as you're merely taking a simple hook or riff, go for it.
    but, as dpalive said, don't go balls out obnoxious with the sampling and make a very small percentage of it your own. legal battles are sure to rise, and no one's going to consider you a creative person.
    i don't like avicii, but what flo rida did with "levels" just left me thinking, "holy ****, creative standards are reaching an all time low". same with jason derulo's horrid attempt on reviving "africa" by toto. i wanted to punch his throat so damn hard.

    with that said; nice track, i enjoyed it. =]
