    That's just splitting hairs imo. A copy of a set from the same tour versus a different set is different? Just weird.

    it's considered different legally. crowd members were allowed to make their own recordings of most of the shows (this rule varied based on the venue), so a fan-based recording of Bercy or any other show would be fine. a recording ripped from the album CD, is an illegal use of copyrighted material. (you might be able to argue for fair use, but i'm kind of doubtful...)

    it's not something i'm making up, it's just how the law views things. (IANAL, but i have studied copyright and fair use with regards to new media.)

    It's only against the law if they profited from it. Fan made production is fair use. Which does not fall under piracy.
