    Sampling Policy, Please Help !

    So i wanted to started making things under french-house. And most of french-house superstars, daft punk themself and madeon for a known example have made funky and moody french from samples, wether it's vocal chops, bass samples, effects, screams, or anything that's good to be sampled. Now, i wanted to ask, can i use samples of a track ? Thanks

    hey man, i see ur a new member, im not a mod or anything,
    but this belongs in the Your Music section

    mods will correct this soon,

    and if u need to sample tracks, u need to get permission from the artist ur sampling, they may not clear it or they might

    you just have to hope

    You can sample whatever you like, it only needs to be cleared if you decide to release it commercially.

    That's what i always thought, but apparently, technically, you are not allowed to sample at all, even if you do it as a free download or soundcloud, although you will never get into any trouble about it.

    Yes, you're not allowed to sample at all if you show it to anyone, but I've never heard of a case where a non-commercial (released for free) song got into any legal issues.

    Also, the less known the sampled track is, the safer you are. I wouldn't recommend sampling top 40 songs anyway.

    so if i sample one track and don't ask permission from the artist, just write on my vinyl "Sample: written be @username@ " - it will be cleared sample?

    Sorry, that's not how it works. It seems to be pretty complicated, the easiest way is to just use royalty free samples. You could also use samples anyway if you make the sample unrecognizable or release the song for free but it is still technically illegal.

    ....or you could create your own samples. Hire a little-known funk/disco band to play a few songs, record it, sample as needed. Or you can create the samples yourself with a DAW. I've done that before.

    That's a good way, but usually when you sample I guess it's because the song you want to sample has a sound that's hard to recreate or most of all because it's a really really good song that has a genius part you want to use. If you make the sample yourself or hire an unknown band you might not get an iconic sample that can become a great song. The result can still be good of course and in many cases the sample is not a crucial part of the song but if you want, say, Le Knight Club quality songs made almost entirely with samples you need great samples. I'm not saying you can't make great samples yourself though, I hope you get what I mean.
